Well, if no lawyers were allowed to hold office we would not have had Lincoln. On the other hand, we would not have had Nixon and Clinton and both Hilary and Obama would have to resign which is a good thing. And, we still would have had Reagan and both Bushes. I do not think we could pass a law banning lawyers from holding office as it would be unconstitutional.

Regrettably, I have to agree. It is disgusting what many in the legal profession have done in the name of "advocacy".
 
I struggle with all of the anti-lawyer stuff... Yes there are a sh!t pile of them that are complete dirtbags, but at the end of the day, a lawyer doesn't have standing to sue someone without an "injured" party. People who don't have the moral compass to realize that they are doing something wrong by suing someone else as a result of their own incompetencies and irresponsibilities are the root cause. And yes, like a chrome plated Desert Eagle, lawyers are an "attracitve nuisance" but none the less, some non-lawyer has to pull the trigger to get them to go...

Bottom line to this discussion, whether it's lawyers or politicians, is that the American public needs to stand up and take responsability for the decisions that are made in this country. And frankly I don't see that happening. Personal responsibility and accountability are gone. It's not part of the fabric of modern society. And until that changes, one way or another, we will continue our rapidly accelerating downward spiral...

I half way agree with you but you can’t turn on TV here and not hear a lawyer planting a seed of (I may have a case)

"Was your baby removed too soon with a C Section? You may be entitled to compensation“ comes from one ad and law firm.

Later on the same channel comes another commercial " Did your baby suffer from brain damage because it was not removed soon enough with a C-section? You may be entitled to compensation"

We have more lawyers here offering the "No Pay Guarantee" "we don’t win you don’t pay" it is a lottery waved under the noses of desperate people

It is Just plain WRONG and the political system won’t help to change it because they won’t ruin their buddies livelihood

You are missing one point that needs to be made.

Civilization has removed the natural selection process of survival. Therefore the 80/20 rule applies. 20% of the people cause 80% of the problems and expenditures. So, I bet of the 100's of people you know, you would be tough to name 20% who have filed frivolous lawsuits. Why, you don't hang with those kind of people. But, I would bet money the 80/20 rule applies.

So, do we eliminate the 20% who cause 80% of the frivolous expense? Remember, it's most likel;y 20% of the population and 20% of the attorneys.

That is what government is supposed to protect us from. That is what they fail at.
 
Sounds to me like it's a case of people being too stupid or irresponsible to realize that just because they see something on TV doesn't mean they should do it. I assume that those are the same people that gave rise to the "The events and actions you see on this show are being performed by trained professionals, do not attempt these actions at home."

The Fon Du Lac thread up on the dock is living a parallel life to this one in some respects.

At the end of the day, the general populace of this country are stupid, lazy and irresponsible. Until that changes, we're screwed.
 
And "governement protection" from things like this is really just the flip side of the same coin. It's overreaching for "us" instead of over reaching for "them"...

Ultimately, there's also an issue of what we really want to be. Do we want to be a free market, do we want to be a majority ruled democracy, do we want to be a govenment controlled welfare state (irrespective of who's welfare we're protecting)?

I'm not saying any is right or wrong. I just think the root cause is a complete lack of integrity and moral compass by the "majority" (and in deference to your 80/20 rule, maybe it's the loud minority) of people on this continent.

This is exactly what the current health care debate should be about. Are we a free market capitalist system or not? If so then stop talking about government options. Reform the private insurance system to create more competition. Generally, increased competition leads to better quality and lower prices.

I used to think lawsuits were the reason health care was so expensive.... now that I work in a hospital...holy crap, the amounts of tests (CT's, Xrays etc) that are needlessly done as revenue generation is insane. got a boil on your back? CAT scan...stubyour toe?? chest xray

Most I talk to say it is to minimize lawsuits. If you smash your arm in a car door and it hurts, you have to have a chest xray because if you die of a heart attack 6 months later, it's the Dr/Hospital's fault for not catching it when you were there and your relatives will sue..

I read in a journal that 80% of Doctors admitted to ordering extra tests at one time or another to cover their butts with the liability insurance people.
