Hans Baumgarten, 56, ignored warnings from other Key West boat captains and agreed to take two Cubans deep-sea fishing when they flashed a wad of cash. The next day, his body was found floating at sea. Rivas and a buddy were soon captured in Baumgarten's 23-foot boat, the Cowboy II.
Rivas, who claimed to have arrived by raft in Florida a year before the 1992 killing, was desperate to get back to Cuba. But the fishing boat ran out of fuel. Baumgarten's death was pointless.
''It was not a pretty death,'' Roy said. ''He was slowly tortured. It took him at least four hours before he died of hypothermia. He had to stay out there in that big lonely sea knowing there was no chance of anyone finding him. Rivas deserves no better.'
