Is it any different than any other kind of theft?

Here's a photo that Jeff (Freeze Frame) posted a while ago. (Thanks, Jeff! Hope you don't mind if I link to it)

Here's my reply when I saw it on the other site:

That's a real purty banner.
I wonder how much it cost to print and hang something like that? Banners that big ain't free.

I also wonder who authorized the use of MY FRIGGIN PHOTO without paying for it or even bothering to ask my permission? :mad:

one other little detail: the photo is from the 2008 SBI National Championship in Panama City.

Wow that is a bummer. Just to be clear you are not mad at Jeff but the lake cumberland grand prix people correct?

Who is responsible for posting the photo?
And how did they get it?
I'm just trying to make sure I'm not missing the chain of events here.
 
Ron Polli- What the heck is going on. After the problems I had with you and Extreme Boats mag using my images without asking on various news items in the mag I thought you would have decided to be more careful and ask photographers before using their images.

This is just a case of blatant theft, plain and simple. Its Jays image and everyone including Ron knew it, so why just steal it and use it. If it was me I would be sueing OSS.

What really dissapoints me is that I was working with Sean Stinson to try and get Class 1 and WPPA to work with OSS for a usa based event for Class 1, but after seeing this NO WAY and will be sending Marco, Saeed and Sid an email to this effect. Jay is doing a lot of work for my magazines and to see his images stolen sucks.

Ron and OSS should hang their heads in shame. :mad::mad:

It seems that they did not ask the one person that matters, that being Jay. I can cut and show my friends Jays pictures but once you are using it for profit it is a whole different ball game. I am willing to bet that it was the not asking that has Jay mad, well that and that he is a commie but that is for another thread :D

You're missing the point, but to clarify:

Jeff took the photo at Lake Cumberland and posted it.

The banner in the photo has one of my photos on it.
Nobody asked me for use of said photo or even bothered to ask me if they could use it.

I'm getting more pizzed by the minute.

I fully agree Jay deserves all credit for his photo's, rightfully so.

OK, I understand now.
So, a photo taken of a photo used in advertising, that you took.
Did you sell the photo to the whoever used it for the advert/banner?

'They' is whoever approved the art and signed off on production of the banner. That would be OSS and/or lakecumberlandgrandprix.com.

For this kind of use I guarantee you I deserve more than 'credit'.

I'm trying to get ready to leave for Marathon in the morning, but I'm sure I'll have some answers by the end of the weekend.
 
Jay while you have ever write to be ****ed off try and take a deep breath and handle this as profesionally as you can. I would honestly pull the thread tell you get some answers. Try and contact Ron and the guys from the grand prix and see what happens. Maybe some one made a mistake and maybe they will make you whole?

Are you saying that you were not compensated for the photo?
If the photo was Heisted, you deserve more than compensation.
Was the photo posted anywhere by yourself, or anyone else?
I understand you're upset, but you don't have a watermark on the photo, and now it turns into a he said/she said of where it came from, or if it belongs to public domain because it was offered out there for free somewhere.

I must admit, it's a great shot.
 
AudioFn and Buoy - Everyone who visits the forums here and OSO knows that these are Jays images so they cant claim the igonorance defence. And in fact Polli and Extreme Boats did the same thing to me and my images a couple of years ago.

Polli is President of OSS and they are involved with that race so he would have known exactly what was going on. Even to the stage where when he arrived there for this race and saw the banner could have said Wow maybe we should check and see if we got the ok from Jay to use his image.

And why pull the thread down, Polli and OSS have been busted stealing Jays image, plain and simple, so let it stand. There are a number of us who bust our asses getting around the place shooting pics of boats, myself, Jay, Sharkey, Gerardi so why the hell shouldnt we stick up for ourselves in cases like this as it costs us thousands for travel and expenses and yet associations think they can just steal the images with no thought towards those who shot them.

Buoy, I do have a watermark on the image (look closely at the photo in post 1- see it? gold lettering, says NAPLESIMAGE.COM). They conveniently cropped it off.
 
So if they cropped the copyright logo off the image that shows blatant intent of theft. What a bunch of A$$HOLES.

They knew exactly whose image it was and still stole it.

I feel that way right now, Ned... but tomorrow I will cool off a bit.

One of the things I do is I don't put my watermark on the subject matter (the boat) of my photos because I feel it really degrades the viewing experience.

This sort of thing sure makes me think differently.

Then place the watermark over the main subject of the image. Having it on the edge does no good.

Curious . If thats from an SBI race did you ever get compensated by ANYONE for that pic.?

Did SBI ever want it and pay for it ?

Can't imagine how stupid a race organizer is in stealing a pic from another organizers race.
Sorta like Macdonalds having a pic of a Burger King burger on their menu.

You got every right to be ****ed off. And I hear you regarding more than a CREDIT .
