BRECKENRIDGE, Colo. (AP) - A Colorado man who claimed he was trying to defend himself from a mugger when he shot himself in the groin has been convicted of illegal discharge of a firearm. Investigators said there was no evidence to substantiate David Leroy Blurton's self-defense claim and jurors convicted the 50-year-old on Wednesday. The shooting happened at the parking lot of a grocery store in Dillon, Colo., on May 2009. Prosecutors say Blurton had been drinking.
Jurors also convicted Blurton of "prohibited use of a weapon - drunk with a gun" and reckless endangerment. Prosecutors said they will request that Blurton be sentenced to probation.
Blurton maintained that someone hit him in the back of the head and he was trying to defend himself.

A neighbor of mine was convicted of negligent homicide
We had a roaming agressive pitbull in the area,my neighbor heard the pit barking up a storm
and saw movement outside ,being that him and most the neighborhhod was fed up with that damn dog he went outside and and shot at it thinking it was the dog that had tried to attack him earlier in the week.
The movement in the yard turned out to be an intruder hiding in the bushes (a convicted felon/sexual offender)
with his pants down and weiner out! and the single shot killed him.
The man being honest said he never knew the man was there and
thought he was shooting at a dog . (it legal to shoot in our area by the way)
They argued since he didnt know there was an intruder that he was guilty.
We had half the hood there to speak on his behalf and they were ignored.
The lawyers presented the mans criminal past and deviant sexual convictions and that was suppresed.
He got 8 years! (had it been anywhere else in Texas besides friggin bleeding heart Austin I am pretty sure he would be free today), a good hard working husband and great neighbor while
known meth dealers get a slap on the wrist and sent home.
Goes to show the truth isnt always the best way to go.
 
yes, its is we were all in shock.
Everyone in the hood has been helping out his wife
but we dont know how long she can pay everything on her own.
DA was out to nail him from the start.
Austinites really really dont like the fact that we can shoot out here.

I agree that what happened to the man was unfair, but I would not agree with his actions necessarily. Even in a self defense situation, you need to identify your target.

Flip side is that it seems to me if he is justified in shooting the dog in self-defense, his intent would transfer to the victim of the shooting. Did he take it to a jury trial or take a plea?

Basically if he would have lied he would probably be free or a pat on the wrist.
If he would have big money and an expensive kick ass lawyer he would be free or a pat on the wrist.
The legal system doesnt reward honesty or help the average Joe.
God help anyone accused or sued wrongly that doesnt have 50K+ laying around for legal defense.
Its not about justice , its about Benjamins..
 
While I feel sorry for the man and his family, one of the first rules of shooting is ID your target. It could have been a child in the brush.
 
While it sucks, ID your target, had the perv been raping the neighbors 13 year old daughter in the bushes, she would/could be dead too. Yes a very ugly and unlikely example, but then so is a jerking off sex offender....

He did what a good US father would do at all times..protect his famalie and himself !!!

He didn't ID his target.

Shooting at unknown objects or persons is not a freedom that is legally enjoyed here, Scott. :USA:

A good father would ID his target and balance his right to protect his family with his ability to earn a living by not being incarcerated. Plus, it's the right thing to do.
