Setback for Reggie?

Funny you said I should take an economics course. I have taken Macro and Micro Economics. I have taken MBA courses, and and have a Juris Doctorate too, so I have answered that question that you asked. I am an Attorney (criminal practice), though I do not practice Bankruptcy Law. Flying colors (an insult) you also wrote in regards to Reggie Fountain but since I defended him the extension is that my, "Smarty's Flying Colors" are also shown? With that said, I do forgive you if that was a backdoor/indirect insult. You seem very passionate on this topic, and I am not that passionate about this topic.

I did not write the Bankruptcy laws, they have been in place for many, many years..Chapter 7, Chapter 11, and Chapter 13.

link to Chapter 11 ( I read in a previous post that the Fountain Bankrupcty was Chapter 11, maybe this will help some of the members of this website understand what is going on in Bankruptcy law and rules).

http://frwebgate.access.gpo.gov/cgi-bin/usc.cgi?ACTION=BROWSE&title=11usc

And to answer your question "have I ever had to be responsible for something?" Yes, I was convicted of DWI (drunk driving). And to answer your other question, " have I had anybody default on me?" I have had many a client not pay me in full (or at all), and I got over it. It was the risk of doing business. And since you typed Jesus, I do believe in God, Jesus, and the Holy Spirit. I am a forgiving type of guy (I am a Christian/Catholic).

I get the impression that even if Fountain was not in Bankruptcy your opinion and comments of him would remain the same, you just seem very angry. We are all entitled to our opinion(s), and my opinion on this matter is different from your opinion. I will not engage in a debate/argument over Reggie Fountain and or Fountain Boats, it is not that important to me. Watching the Eagles and Phillies play today and tonight is important to me.

Have a good day, I will not respond after this post, PM me if you have further questions or comments regarding my response. Stephen

Figures you're a defense lawyer...No wonder we disagree!:sifone:

I can agree to disagree. I appreciate your response and understand where you're coming from. My point is bigger than just RF. I think the whole BK route is abused in this country as it is and the mentality of an easy way out that goes with BK has lead to the economic shape we're in. There's just no accountability anymore. And yea, I don't really hold RF in the highest regard as it is and this whole debacle just firmed that up for me. And I really don't agree with having him retain control of the company he ran into the ground. His past accomplishments on the race course or whatever he's done for this sport really shouldn't be used as an excuse to dismiss what he's done. Just my .02.

Passionate about this topic? I'm passionate about this sport and what goes on in the industry. Will I lose sleep over Fountain, not a wink. matter of fact when I get up from this computer it will be gone from my mind until the next time I peruse these threads...See you then:seeya:

Hey Tank whats up buddy....you coming to FL anytime soon??????

Not this year. New baby and all. We'll be out that way next year a couple times hopefully. Definitely need to hook up brother. Kelly and I were just talking about the night in Newport at the Hyatt where you tried to rent the Prez. sweet for all of us to party in....Ahhhh, the good 'ol days:sifone: Hope all is good bro.

2112,

If I had your experience, I'd be angry too. I know a lot of Fountain owners who are very satisfied with their boats. You, clearly, are not one of them, and based on your experience who could blame you.

What T2X refers to is, in less than classic economic terms, called clearing out the deadwood. Though it might be necessary, I would still argue that it's nothing to celebrate.

I would also argue that mix of the characters in this industry, from humble to "self-aggrandizing," is what makes it so compelling. You've got a guy like Peter Hledin, who is quite confident but lets his boats speak for him, and then a guy like Reggie Fountain, whose style is ... completely different.

Fred Kiekhaefer of Mercury Racing, Randy Scism of MTI, Lee Kimmell (formerly) of Donzi, Bob Leach of Eliminator, Wayne Schaldenbrand of Sunsation, Mike Fiore of Outerlimits, the list goes on and on. They are all quite different. They all have distinct personalities.

Call me crazy, but that's one of the things I truly love about this industry.

Recall John Donne, "No man is an island, unto himself. Every man is a part of the continent a piece of the main. If a clod be washed away, Europe is the less."

All that wisdom, plus a poetry lesson.

Bro those were the days.... so how many kids do you have now 2??? How's the land of Cali treating you I do miss it out there!!!!

The liberty deal was the best deal on the table as far as the creditors were concerned (with the exception of Oxford of course).....The principles of Liberty have been very successful in other business ventures..... who knows, maybe the combination of their business savy and Reggie's "flair" will work

Although I only agree with a portion of your posts. Dont be so quick to think that everyone is celebrating fountains demise rather than we as people, businessmen and employees alike are tired of watching CEO's of company's loot them and then shrug their hands and say "oh well" or "poor me, someone give me a another chance". this isn't about him as person, at least to me it isn't...it wreaks of corporate arrogance, he played with the fire and now got burned...nothing more nothing less.

Since we're talking about arrogant CEO's who have filed bankruptcy after running their companies poorly, but come out smelling like a rose. I CAN"T STAND TRUMP, what a POS.......:boxing_smiley:

There, a little better now....:sifone:

Offshore,

I am not being quick to think anything ... I am only reading some of the mean-spirited posts and responding to them. I am responding to the personal attacks on Mr. Fountain, which are are, in my view, uncalled for. And yes, I am also responding to the myopic view that Fountain's failure is something to cheer. There is, my friend, a lot of that out there.

The simple fact is: Right now, there are no "production" high-performance boat companies (other than Formula) in business. So if you want a go-fast V-bottom, you are looking at custom (or pre-existing or pre-owned) inventory. If you don't have the bank, forget about it.

Oh, and trust me, I am right with you in terms of greedy CEOs. That some fat cat gets a huge bonus after his company LOSES money disgusts me in the same way union greed disgusts me. It's the other side of one coin.

No problem with you disagreeing with me on anything, ever. Civil discussion, even when we might have strongly opposing views, is really good stuff.

Yea, you can rest on the "Cost of doing business" cop out and blame it on the banks for lending the money in the first place. But really, all youre doing is shifting responsability and in the end rf's true integrity and self worth shows through in flying colors! Dont try to blame others when you've defaulted. Don't push the responsablity off on those
youve promised to pay. Jesus, go back and read your post! Have you ever had to be responsible for something? Have you ever had someone default on you. There's no blame game. Just Basic deuchebaggery and the same thought process that has lead this country into the financial crapper. He gets away with others money...bottom line. And guess who pays in the long run...those owed money need to recoup their finances somehow. Guess how that's done. Raising rates. That means we pay more in the long run for tour boy Reggie running out on his bill....example: fountain owes a million in payment to mercury but just skated on it in bk. Mercury claims it as a loss and raises their prices to recoup the coin over the next few years. Go take an economics course and maybe you won't stick up for this fu
*ckin loser!

After careful consideration

I think we should give this topic a rest. The man is in the fight of his life and no matter what we post on this website, nothing on here will affect the outcome. Let's simply back away from this until it is decided in one way or the other. This issue is pitting friend against friend...and frankly it's not worth it.

The boating industry is in a shambles as are most of the other recreational based supply chains. There are much larger forces at play here that threaten our entire economic fabric and lifestyle. Why waste time on a tree when the forest is the story?
