I actually agree with Jay on something. I guess the world is ending. ;) I hope Fund has it right though, just a mistake. It does seem intentional since the photo was cropped right at the water mark. By the way Jay, I have that same shot on my desktop. I hope your ok with that. :D
 
I agree that admittedly its a compliment to Jays photography.
All the guys with cameras put a lot of effort into their work to our benefit.

Their hard work on our behalf should be applauded.

To all of you hanging out of helicopters this race weekend ..be safe.
 
Jay if you want I know of a web site that allows you to show your pictures and then if the person wants an original they can download it for a fee. Just let me know. Actually I may as well just give it to ya. http://www.gettyimages.com/ Do a search it will blow your mind what you can find on there.

Me too. But I don't mean to suggest what happened. Rather, that we don't really know what happened, or the intent behind it.
 
Didn't expect to wake up to this one.

Jay will get to the bottom of it I'm sure. And he'll let us know the truth of the issue. My guess is Ron would no way do that on purpose. And the racers in OSS all know Jay so they wouldn't allow that sort of thing on purpose either.

Speculation says whoever was in charge of promotion asked Geico if they had any pictures, Geico said yeah and that was one of their favorites laying around, and the promoter used it. Having no idea, and no intention, of a copywrite infringement issue.

Heck, when I make a copy of a photo like the SOS flyby gif with Jeff's photo, I pm Jeff and make sure it's okay before posting. And give the credit in the post.

I was just at a Kinkos yesterday and got to listen (again) to their employee explain copyrights to a customer. People simply don't grasp the concept of copyrights. Pictures, music, software, their employer's customer lists and so on. And it baffles me- these are typically people that in their entire lives wouldn't dream of shoplifting a nickle gumball, but they'll poach a bootleg copy of a $400 software packahe or put ten grand worth of songs on an Ipod.

While this is definitely wrong, I'm going to have to say at this point that it's ignorance, not malice on this one. The Geico guys just wouldn't deliberate clip a corner on something like this. A nd I bet OSS asks everyone in the future if they own their marketing materials.
 
We are not even allowed to take a picture of our theaters with a movie on them for advertising with out getting permision from the movie studio first. That is why we use images that we took and put them up on the screen.

I feel for you brother ! I lost count how many times my images have been taken that I know about.

And people ask me why I went back to posting Low Resolution Images with a Watermark.

My last image I found was sold to an advertiser on OSO. Someone from OSO decided to take my image and use it in their advertising.
The company that was advertising was unaware of this situation.

Fortunately I also picked this company up as an advertiser and decided not to press the issue with OSO. Another reason you won't find future images posted on that site....

If indeed you know for sure that the MGR team had the banner made, just send them an invoice and I am sure they will pay you. One of my images was used on their poster a few years back and I just billed them and got paid.

This stuff happens more than people would think.

No need for screen saves and editing out watermarks. :ack2:

Several years ago I took some pictures of an event and shared them on a forum. The next year I found my pics on the event's website. No attempt was made to contact me via PM or email to ask to use them or post them. I'm was kind of suprised to see them and I have to admit a bit irritated at the time but eventually came to the conclusion they liked them enough to use them. They were taken for my use and I'm not a professional photographer by any means.....but a little credit would have been nice..
 
I have had it both way. Some people have asked and some stole from me. It is a bad deal when people steal from you. For this reason I put watermark on all my photos I now post on the internet. Having said all that, Jay, I think I can see how they MGR might have thought the pic was OK for them to use since they paid for it. I also see your side of it, you thought you were selling the pic for a reproduction by MGR only, not for others to use.
 
Personally, If someone wanted to use a photo of mine, I had only wished more people would have used the one for John B in my Signature..... I would have no problem with that....
 
I feel I need to clarify something.
Jay, you were wronged, and your pics were stolen in my opinion.
What I had said about "putting photo's out there", and they become fair game, I meant that as us amateurs that just post stuff.
My apologies if you took offense, or if I was not clear of what I meant in my post.
Find who is responsible for the infraction, and I'm certain they will make it right.

Jeff- If it was MGR then sorry but dont buy that as they have a very well oiled media machine and know all about what is right and what is wrong. They have worked with many photographers over the years and know that buying a pic for $50 doesnt entitle them to use it.

Ask Sharkey, Gerardi and others out there who do it for a living and they will back this up.

Lets see what Jay finds out.

Ned, I agree MGR knows what they're doing in the field of advertising. A few years back Marc contacted me about the use of one of my photos for an ad. They ended up not using it, but Marc did ask prior to not using it. I was just saying, if it was MGR and they already purchased the photo, then I can see where they would have thought they could use it. Having said that, I do not believe it was them that made the banner. Although, who ever made the banner, had to get the photo from someone and that is where the problem lays.
 
That banner was made by the Group from Lake Cumberland. OSS had NOTHING to do with it or it's printing. I would check out the Lake Cumberland Web site and contact the group there or at MGR.
